Does Your Business Need a Mandatory Energy Audit in Morocco?

Industrial businesses above 1,500 tonnes of oil equivalent a year, and tertiary or other listed consumers above 500, enter Morocco’s mandatory energy-audit process. The calculation combines purchased electricity and fuels across the relevant business entity.

Mandatory-audit applicability begins with the complete annual purchased-energy boundary, not with one meter or one utility bill.
    01 · Who is covered?

The rule begins at two sector-specific energy thresholds.

Morocco requires certain large energy consumers to complete a structured energy audit. The obligation does not apply to every business of the same size or with the same electricity bill.

Law 47-09 is Morocco's energy-efficiency law. It requires the country's largest energy consumers to examine how energy is used and to prepare an improvement plan. Decree 2-17-746 supplies the thresholds, audit cycle and approved-provider rules that make this requirement operational.

Industry is covered when annual final purchased energy is above 1,500 tonnes of oil equivalent. Tertiary activities such as tourism, health, education, commerce and services use a threshold above 500 tonnes of oil equivalent. The 500-toe threshold also applies to listed energy transport and distribution activities and to covered individuals.

A tonne of oil equivalent, shortened to toe, is a common unit used to combine different forms of energy. A large hotel using electricity and fuel for cooling, kitchens and hot water must therefore review the combined annual total. The current thresholds and five-year requirement are published by the Ministry of Energy Transition.

02 · What enters the threshold?

The threshold combines purchased electricity and fuels across the business.

Eligibility is based on annual purchased energy converted with official coefficients. The legal business boundary matters as much as the meter readings.

The business boundary determines the annual energy total.

The calculation combines purchased electricity and fuels across the relevant entity. The applicable sector then determines which legal threshold is used.

Conceptual scope model based on Decree 2-17-746. It explains aggregation and does not calculate a reader's legal status.

Only purchased electricity and fuels enter the calculation described by the decree. When one company operates several Moroccan sites without separate legal status, their purchased energy is combined. A separate company requires its own sector and scope review.

The current coefficient assigns 86 toe to one gigawatt-hour of electricity. An electricity-only total of 500 toe is therefore about 5.8 GWh, and 1,500 toe about 17.4 GWh. Those figures are orientation only: purchased gas, LPG, fuel oil or other covered fuels must also be converted and added using the official annex. See the enacted framework and conversion table.

03 · What happens after crossing it?

Crossing the threshold starts an audit and reporting cycle.

The covered consumer remains responsible for the declaration, provider appointment, complete audit scope and records sent afterward.

    1. 01

      Declare the annual total.

Communicate the annual energy data to AMEE using its current declaration process and retain the submitted calculation and receipt.

    2. 02

      Start the mandatory audit.

A business above the applicable threshold must begin the audit and use an organization approved for its sector.

    3. 03

      Name an energy representative.

A qualified internal contact coordinates information with the auditor and follows the resulting efficiency plan.

    4. 04

      Cover the complete scope.

The audit addresses the relevant activities, processes, buildings, vehicle fleets and total purchased energy of the covered consumer.

    5. 05

      Submit and continue the record.

The published guide describes report, summary and action-plan submission, followed by annual implementation reporting and another audit within five years.

The current official guide describes sending two report copies, the results summary and the efficiency plan to the energy ministry within 30 days of receiving them from the auditor. Confirm the ministry's current receiving channel before filing. Review the published mandatory-audit guide and the AMEE declaration page.

04 · Which provider or exemption applies?

Approved auditors, ESCOs and ISO 50001 have different roles.

The status attached to one service cannot be assumed to cover another. Check the current list and the exact sector before signing.

    Approved mandatory-audit organization

This is the provider category authorized to perform the legal audit. The approval identifies the sector it covers, so the current AMEE list of approved organizations must be checked before appointment.

    Authorized energy-service company

An ESCO can develop an efficiency project tied to measured performance. ESCO authorization does not by itself establish mandatory-audit approval. The distinction is explained in the Journal analysis of Morocco's ESCO framework .

    Certified energy-management system

Activities covered by a valid energy-management system certified under the applicable Moroccan standards are exempt during the certification period. The decree still keeps annual energy-data communication in scope.

    Voluntary audit below the threshold

A business can still commission an energy audit for investment planning. That work should not be presented as the mandatory process when the legal threshold, scope and approved-provider requirements do not apply.

    05 · What proves compliance?

Compliance is demonstrated by a complete record.

The useful evidence connects the annual threshold calculation to the audit, submitted plan and continuing implementation record.

    Applicability calculation
Annual bills, purchased fuels, entity scope, sector and official toe conversion.
    Declaration evidence
Submitted AMEE data and the retained confirmation or receipt.
    Provider status
Current approval and sector scope when the audit contract is signed.
    Audit submission
Report, results summary, efficiency plan and proof of delivery.
    Implementation record
Annual reporting, completed actions, unresolved measures and supporting evidence.
    Next review date
Five-year audit due date and any certification expiry affecting an exemption.

If a covered business does not complete the audit

Law 47-09 allows the administration to issue a formal notice and a deadline to correct the situation. Article 23 provides a fine of 30,000 to 300,000 MAD for a covered person who does not have the audit performed, with the penalty process subject to the notice provisions stated in the law. This is a legal provision rather than a prediction about one business.

Businesses that need help understanding what an audit should examine can use the Technical and Energy Audit Playbook . Legal applicability should still be checked against the current official framework.

    Conclusion

Begin with one complete year of purchased-energy records.

Collect electricity and fuel records across the relevant business boundary, convert them using the current official coefficients and document the sector conclusion. If the total is above the applicable threshold, preserve the declaration record, appoint an approved auditor and track the resulting plan through the next five-year cycle.

A single bill or informal estimate cannot close the compliance question. Keep the calculation, provider approval, submission evidence and annual implementation records available for the next management and regulatory review.
